1. The agreement
These terms are between you and Mint Apps, based in Italy ("Palestrico", "we"). They cover the Palestrico mobile app, this website and any related support. The app is offered in Italy at launch, in English and Italian; there is no web version of the app. Our privacy policy forms part of this agreement.
Your app store's terms apply to downloading the app. Palestrico Pro is purchased through Buy Me a Coffee, whose terms and payment provider's terms also apply to that transaction. Where a mandatory platform rule conflicts with these terms for a transaction handled by that platform, the platform rule applies to that transaction.
2. Eligibility
You must be at least 16 years old. Sign-up below that age is blocked with no exception, and we will close any account we find that breaches it. You must be able to enter a binding contract, and you must not be barred from using the service under applicable law or sanctions.
3. Your account
An account is required. Give accurate details, keep your credentials to yourself, and tell us promptly if you think someone else has access. You are responsible for what happens under your account. Accounts are personal - do not share, sell or transfer one. One person, one account.
Until you verify your email address, we cannot recover your account for you. Verifying your account does not back up the workout data stored on your device. The app says so, and you can keep training in the meantime.
4. Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Palestrico on devices you own or control, for your own non-commercial training. You may not copy, modify, reverse-engineer, decompile, resell, rent, sublicense or create derivative works from the app or its content, except where the law expressly permits it. Using our curated programs to coach paying clients requires a separate written licence.
5. Free and paid tiers
The free tier is a complete offline tracker: the full exercise library, unlimited plans you build yourself, a set of starter programs, all set types, personal records, the rest timer, reminders, body measurements and a capped number of progress photos stored on the device.
Palestrico Pro includes everything in the free tier and removes advertising. Cloud sync for workout data is planned for a future update, but it is not currently part of the service. Which features sit in which tier can change as the product develops; if we move something you already rely on out of the free tier, we will tell you first.
6. Subscriptions and billing
Palestrico Pro is sold as a recurring annual membership for €49.99 through Palestrico's Buy Me a Coffee page. Buy Me a Coffee provides the membership checkout and management service, and its payment partner processes the charge. We never receive your full card details.
The membership price is the price shown on Palestrico's Buy Me a Coffee page. Prices can change; any change to a recurring price will be communicated as required by Buy Me a Coffee's rules and applicable law.
The membership renews automatically each year using the payment method associated with your Buy Me a Coffee membership. To stop the next charge, cancel it from your Buy Me a Coffee account before the renewal date shown there.
If a renewal payment fails or Buy Me a Coffee reports that the membership is no longer active, the ad-free benefit stops. Your on-device workout data is unaffected.
7. Cancellation and refunds
Cancel from Buy Me a Coffee under My Account, Payments, Membership before the next renewal date. Cancelling stops future recurring charges. Deleting the Palestrico app or your Palestrico account does not cancel the Buy Me a Coffee membership.
To request a refund, contact us first through the support page. Refund requests are considered under these terms, Buy Me a Coffee's refund process and applicable consumer law; approval is not guaranteed except where the law requires it. Nothing here limits any mandatory consumer rights you have.
8. On-device data loss
This is important enough to state as a term, not a footnote. Workout data currently lives only on your device on both the free and Pro tiers. We hold no copy, so if the device is lost, reset, damaged, or the app is uninstalled, that history cannot be recovered - by you or by us. A device backup is currently the only protection. You accept this risk when you use the app.
9. Health and safety
As set out at the top of this page: Palestrico is not a medical device and provides no medical advice, diagnosis or treatment. Programs, rep ranges, estimated one-rep maxes and strength standards are informational calculations. You are responsible for training safely, for using appropriate technique, equipment and supervision, and for seeking professional advice about your own health. To the extent permitted by law, we are not liable for injury, illness or loss arising from exercise you choose to perform.
10. Acceptable use
Do not: break the law with the service; upload content that is illegal, abusive, or that depicts a person who has not consented; upload sexual content involving minors under any circumstance; attempt to access another user's data; probe, scrape, overload or interfere with our systems; circumvent tier limits, entitlement checks or advertising; use automated means to extract the exercise library or program content; or impersonate anyone. We may suspend an account immediately where we reasonably believe this clause has been breached.
11. Your content
Your plans, sessions, notes, measurements and photos are yours. You keep all rights in them. They are currently stored on your device, not hosted or synced by us. We do not publish your content, do not use it for advertising, and do not use your progress photos to train models. Export and delete are available in the app at any time.
12. Our content and intellectual property
The app, its design, code, name, logo and the curated programs are owned by us or our licensors and are protected by intellectual-property law. Nothing in these terms transfers ownership. The exercise catalogue and its demonstration media are used under their respective licences and remain the property of their owners; they may not be extracted from the app or redistributed. Feedback you send us may be used freely, without obligation or compensation.
13. Advertising
Free accounts include advertising throughout the app, including inside a live workout, capped in frequency. Ads are supplied by third-party networks and we do not endorse what they promote. Paid accounts show no advertising. Where consent is required for personalised ads, declining does not restrict any feature of the app.
14. Availability and changes
The app is offline-first, so most of it keeps working without a connection. Purchase and sign-in need one, and those services can be interrupted for maintenance or by our providers. We may add, change or remove features, and we may update these terms - for material changes we will give notice in the app before they take effect. Continuing to use the service after that means you accept the new terms; if you do not, stop using the service and delete your account.
15. Termination
You may stop at any time by deleting your account in the app, or from the account deletion page - remember to cancel the Buy Me a Coffee membership separately. We may suspend or terminate an account for a material breach of these terms, for unlawful use, or where required by law, giving notice where it is reasonable to do so. On termination the licence in clause 4 ends and account data we hold is deleted according to the retention periods in the privacy policy. Clauses 9, 12, 16, 17 and 18 survive.
16. Disclaimers
Except for warranties that cannot be excluded by law, the service is provided "as is" and "as available". We do not warrant that it will be uninterrupted or error-free, that calculations are exact, that a program suits your circumstances, or that data you keep only on your device will survive. Nothing here excludes your statutory consumer rights.
17. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost training data stored only on your device, or loss arising from your use of a training program. Our total liability for any claim connected with the service is limited to the greater of the amount you paid us in the 12 months before the claim, or EUR 50. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
18. Governing law and disputes
These terms are governed by Italian law. Disputes go to the competent court at our place of establishment in Italy - except that if you are a consumer, you may also bring proceedings in the courts of your own country of residence, and you keep the protection of the mandatory consumer law there. We would rather resolve things directly first - write to us from the support page. If these terms are translated, the English version governs.
